Terms of Use for New World Gram

Welcome to New World Gram! These Terms of Use (or “Terms”) govern your use of the New World Gram mobile application (the “App”), and by accessing or using the App, you agree to these terms. Please read them carefully.

1. Acceptance of Terms By using the App, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into a binding agreement. If you do not agree with these Terms, please do not use the App.
2. Account Registration In order to use certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account.

a) Violate these Terms or any other policies or guidelines provided by New World Gram. b) Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with any person or entity. c) Use the App for any illegal, misleading, fraudulent, or unauthorized purpose. d) Interfere with or disrupt the operation of the App or any servers or networks connected to the App. e) Collect or store personal data about other users of the App without their consent. f) Post or transmit any content that infringes upon the rights of others, including intellectual property rights. g) Attempt to gain unauthorized access to the App or its related systems or networks. h) Engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the App or which, as determined by New World Gram, may harm New World Gram or users of the App.

4. Intellectual Property The App and all its contents, including but not limited to text, graphics, images, logos, and software, are the property of New World Gram and are protected by intellectual property laws. You are granted a limited, non-exclusive, and non-transferable license to use the App for its intended purpose. You shall not reproduce, modify, distribute, or create derivative works of the App without the prior written consent of New World Gram.
5. User Content By posting, uploading, or otherwise submitting any content on the App, you grant New World Gram a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the App. You represent and warrant that you have all necessary rights to grant this license and that your content does not infringe upon the rights of others.
6. Third-Party Services and Content The App may include links to third-party websites or services that are not owned or controlled by New World Gram. New World Gram has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that New World Gram shall not be liable for any damages or losses arising from your use of any third-party websites or services.
7. Disclaimer of Warranties The App is provided on an “as is” and “as available” basis, without any warranties of any kind, express or implied. New World Gram does not warrant that the App will be uninterrupted, error-free, or secure. You acknowledge that the use of the App is at your own risk.
8. Limitation of Liability To the fullest extent permitted by law, New World Gram shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of the App.
9. Indemnification You agree to indemnify and hold New World Gram and its officers, directors, employees, and agents harmless from any and all claims, demands, liabilities, damages, losses, costs, and expenses, including attorney’s fees, arising out of or in connection with your use of the App, your violation of these Terms, or your violation of any rights of another party.
10. Termination New World Gram reserves the right to terminate or suspend your access to the App at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
